Mr. Sudip Ghosh Chowdhury Mr. Anindya Bose Mr. Mridul Biswas ........for the petitioner Mr. Sourav Mitra .......for the WBCSSC Ms. Koyeli Bhattacharyya Mr. Bibek Datta .....for the WBBSE Ms. Munmun Tewary Ms. Kalpita Paul ....for the State 1) In terms of order dated 7th August, 2025 matter is taken up for consideration today when learned advocate representing the petitioner submits that petitioner has residence at Garhbeta, Paschim Medinipur and distance in between her residence and present school is 18 KM.

2) Officer-in-Charge of Garhbeta Police Station has made a communication dated 10th August, 2025 to learned advocate representing State respondents wherein on enquiry it was informed that the petitioner is permanently

residing at Village -Lapuria, Post Office and Police Station -Garhbeta, District -Paschim Medinipur. In support of same, one certificate dated 7th August, 2025 issued by Garhbeta Gram Panchayat is also enclosed to the communication of the Officer-in-Charge of Garhbeta Police Station wherefrom it appears that petitioner is a resident of Garhbeta. One Voter Information Slip is also enclosed to said communication wherefrom it appears that petitioner is a Voter of -Jhargram Parliamentary Constituency, her Polling Station is at Garhbeta Umadebi Girls High School and Part Serial Number of the petitioner being a Voter is 41. Communication dated 10th August, issued by the Officer-in-Charge of Garhbeta Police Station along with certificate issued by Garhbeta Gram Panchayat and Voter Information Slip are taken on record.

3) It is surprising that by filing this writ petition petitioner has prayed for transfer and in paragraph 6 of the writ petition it has been averred that distance in between the residence of the petitioner and her school is 58 KM. In the writ petition it is projected that petitioner is staying at Anandapur but not at Garhbeta. It

appears that petitioner has not come before this Court with clean hands.

4) Hence, writ petition stands dismissed with a note of caution that if such conduct recurs in future same shall be dealt with appropriately. 5) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
