Learned counsel for the petitioner submits that although a proceeding has been apparently initiated against the petitioner for non-payment of the dues assessed by the Distribution Licensee, the petitioner is willing to pay the entire amount. The petitioner has given a representation to the Station Manager, WBSEDCL on such score, which is annexed to the writ petition.

Upon hearing learned counsel for the parties, it transpires that the respondent no.3, that is, the Station Manager of the WBSEDCL having office at Baguiati, ought to be directed to consider the said

representation and take a decision in accordance with law on the same.

Accordingly, WPA No. 14619 of 2022 is disposed of by directing the respondent no.3, that is, the Station Manager, WBSEDCL, having office at Baguiati, Kolkata - 700 059, to consider the representation given by the petitioner on June 29, 2022 (AnnexureP3 at page-16 of the present writ petition) as expeditiously as possible, and to take a decision on the same as expeditiously as possible, in accordance with law and upon giving an opportunity of hearing, if deemed necessary, to the petitioner and the Distribution Licensee, preferably within four weeks from date.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
