Petitioner is aggrieved by the inaction of the police authorities and as such approached this Court. The genesis of the case related to an incident complained of on or about February, 2024 in respect of the overt acts of the private respondents as well as violation of the orders passed by the Civil Court. Report submitted by the State reflects that the police authorities took steps on the basis of the information furnished by the daughter of the petitioner no. 1 against the private respondents. The case being Madhabdihi PS Case No. 191/24 dated 22.08.2024 was registered for investigation.

Consequently, on completion of investigation charge

sheet was submitted before the jurisdictional Court against the private respondent nos. 6, 7, 8 & 9. Having considered that the police authorities at the relevant point of time had taken steps, I direct that so far as the establishment or deprivation of the rights are concerned, petitioner would ventilate their grievance before the learned Civil Judge (Junior Division), 1st Court Purba Bardhaman who is in seisin of Title Suit No. 243 of 2024. So far as the other issues are concerned if the petitioners are faced with inconveniences pursuant to the criminal case having been registered, petitioners would approach the jurisdictional criminal court with appropriate applications under the Witness Protection Scheme, 2018. Learned Court would call for a report from the police authorities in respect of the grievance expressed by the petitioner and pass necessary orders under the Witness Protection Scheme, 2018.

With the aforesaid observations WPA 15404 of 2024 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate for the petitioner.
