It is further submitted no narcotic substance was recovered from his possession.

Learned advocate appearing for the Union of India opposes the prayer for bail and submits petitioner and co-accuseds entered into conspiracy and were dealing in narcotic substance above commercial quantity. CDRs. show frequent conversations between the petitioner and co-accuseds before and during the transaction. We have considered the materials on record. Though no narcotic substance was recovered from the possession of the petitioner, CDRs. show frequent communications between him and co-accuseds from whom narcotic substance above commercial quantity was recovered. Investigation is in progress. In view of the stage of the proceeding, we are not inclined to grant bail to the petitioner. The application for bail is thus rejected.
