This application under Article 227 of the Constitution of India is directed against an order dated March 25, 2025, passed by the learned Civil Judge (Jr. Division), 3rd Court, Howrah in Misc. Case No.116 of 2023.

By the order impugned, the misc. case filed under the provisions of Order 9 Rule 9 of the Code of Civil Procedure was dismissed.

The said order being an appealable order under the provisions of Order 43 Rule 1(c) of the Code of Civil Procedure, this Court is not inclined to entertain this civil revision application.

Faced with such situation, the learned advocate for the petitioner prays for leave to withdraw the civil revision application with liberty to approach the appropriate forum in accordance with law.

In the light of the submission made by the learned advocate for the petitioner, C. O. No.2314 of 2025 stands dismissed as withdrawn with liberty to

the petitioner to approach the appropriate forum in accordance with law.

Learned advocate for the petitioner shall be permitted to take back the certified copy of the impugned order by replacing the same with a photostat copy thereof.
