Enamul Sekh v. State Of West Bengal
08.07.2022 sdas rejected C.R.M.(DB) No. 2219 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Kaliachak Police Station Case No. 258 of 2014 dated 08.04.2014 under Sections 395/397 of the Indian Penal Code.
And In Re : Enamul Sekh ..... petitioner Mr. Sujoy Sarkar Mr. Musharraf Alam Sk.
... for the petitioner Mr. Sudip Ghosh Mr. Bitasok Banerjee Mr. Apurba Kumar Datta ... for the State Learned Counsel appearing for the petitioner prays for bail. He submits that his client is in custody for two years. Learned Counsel appearing for the State opposes prayer for bail.
We have considered materials on record. There are ample evidence to connect the petitioner with the alleged offence of dacoity. He misused his liberty and absconded for five years. In view of gravity of the offence and conduct of the petitioner and as trial is in progress, we are not inclined to grant bail to the petitioner.
The application for bail is, thus, rejected. We direct the trial court to expedite the trial and conclude the same at an early date without granting any unnecessary adjournment to either of the parties. (Ananya Bandyopadhyay, J.) (Joymalya Bagchi, J.)
