Mr. Arindam Sen, Mr. Nazmut Touhid ......for the State. The petitioner says that he is in custody for about one year. There is no sufficient evidence against him. All the witnesses who have been examined so far, have been declared hostile. He should be released on bail.

Learned Advocate for the State opposes the prayer. He says that there are in all 30 charge sheeted witnesses. Six out of them have been examined. He says that time frame should be indicated within which the trial shall be concluded. Having considered the materials on record and the possible extent of complicity of the petitioner in the defence, we are not inclined to enlarge the petitioner on bail at this stage. conclude the same as soon as possible but positively within a period of one year from the date of communication of this order by the parties to the learned trial court.

We further clarify that in the event trial is not completed within the time frame as indicated above, the petitioner will be at liberty to renew his prayer for bail.
