The petitioner seeks consideration of the representation made before the Haldia Municipality on September 8, 2021.

The grievance of the petitioner is that Haldia Municipality is not accepting the property tax from him even though he being the owner of the property has expressed his desire and willingness to clear the property tax dues.

None appears on behalf of the Municipality.

Affidavit-of-service filed in Court today is taken on record.

As it appears that the petitioner, claiming to be the owner of the subject property, intends to clear the property tax dues and an application to that effect is pending consideration before the Municipality, accordingly, the present writ petition is disposed of by directing the Haldia Municipality to consider and dispose of the representation filed by the petitioner on September 8, 2021 in accordance with law, after giving reasonable opportunity of hearing to all the necessary

parties and pass a reasoned order and communicate the same to the petitioner.

Steps shall be taken in the matter at the earliest but positively within a period of eight weeks from the date of communication of a copy of this order. The reasoned order shall be communicated to the petitioner immediately thereafter.

It is made clear that this Court has not entered into the merits of the claim of the petitioner and all points are left open to be decided by the aforesaid respondent at the time of consideration of the representation of the petitioner.

Learned advocate for the petitioner is directed to forward a copy of the representation dated September 8, 2021 filed before the Municipality at the time of communicating the order of this Court.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
