Mr. K.B.S. Mahapatra ... for the petitioner Mr. Satyajit Talukder Mr. Arindam Chatterjee ... for the KMDA The present writ petition is heard in presence of the learned counsel for the writ petitioner and the respondents.

By the instant writ petition, the writ petitioner has prayed for setting aside the decision of the respondent charging penal interest as per their letter dated 13th October, 2010.

On being directed by the Court and considering the prayer of the writ petitioner, the respondents have filed a report before the Court today which reads as follows :

"In response to your correspondence in e-mail dated 20.09.2024, this is to inform you that the Authority in KMDA has decided to REFUND Rs.33123/- (Rs. Thirty three thousand one hundred twenty three) only to Sri Shibaji Ghatak which was deducted as Penal Interest of his HBL. The amount will be refunded shortly......" The said report be kept with the record.

It thus appear that the respondents have addressed the relief of the writ petitioner.

Accordingly, the respondent are directed to refund the said amount as stated (Penal Interest) within 30 days from the date of this order.

The writ petition is accordingly disposed of. There will be no order as to costs.

All connected applications, if any, stand disposed of.

Interim order, if any, stands vacated.

Urgent Photostat certified copy of this order, if applied for, be supplied to the parties expeditiously after due compliance.
