The subject matter of the present revisional application relates to the order dated 24.02.2022 passed by the learned Additional Chief Judicial Magistrate, Bidhannagar in connection with G.R. Case No.575 of 2009 under Sections 420/34 of the Indian Penal Code.

Petitioner is directed to serve a copy of the revisional application upon Mr. Arijit Ganguly, learned advocate, who ordinarily appears on behalf of the State. His appointment may be regularised by the concerned authorities.

Learned advocate for the petitioner is aggrieved by the fact that on 24.02.2022 on a put up petition the de facto complainant prayed for fixation of date when warrant of arrest was issued against the petitioner. Learned advocate submits that the petitioner was earlier on bail but to her utter surprise the warrant of arrest has been issued although steps were taken by the learned

advocate representing her.

In view of the submissions advanced and the certified copy so enclosed, I direct that in case the petitioner appears and surrenders on or before 31st July, 2023 before the learned court, in that case, if the petitioner from the records is found to be on bail, she should be allowed to continue on the same bail and bond. The execution of the warrant of arrest so issued on 24th February, 2022 be stayed till 1st August, 2023. The warrant of arrest would be revived on 2nd August, 2023 in case the aforesaid compliance is not made.

With the aforesaid observations, CRR 2232 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
