The criminal revision has been preferred against an order dated 4.12.2024 passed by the learned Judicial Magistrate, 1st Court, Sealdah, South 24Parganas in complaint case no. C/616 of 2023.

Vide the order under challenge the learned trial Court was pleased to dismiss complaint case No. 616 of 2023, for non- appearance of the petitioner. Petitioner also did not reply to the show cause which was directed.

The Court finding no other option was pleased to dismiss the complaint case.

The petitioner now prays for recall of the order in the interest of justice and submits that he shall pursue the case diligently.

Considering the nature of relief prayed for, notice in the present case is dispensed with.

The order dated 4.12.2024 passed by the learned Judicial Magistrate. Ist Court, Sealdah in C/616 of 2023 is hereby set aside with the cost of Rs. 10,000/- to be paid to the State Legal Services Authority, West Bengal.

On payment of cost the complaint case being 616 of 2023 be restored to its file and number.

The learned Magistrate shall proceed with the case in accordance with law without granting any unnecessary adjournment to either sides.

Prior to taking/hearing the case, on the complaint case being restored to its own file, the Court

shall direct service of notice/summons upon the opposite parties, herein.

10.

The revisional application stands disposed of.

Parties to act on the server copy of this order.
