Mr. Somnath Roy Chowdhury, Advocate ...for the Petitioner The grievance of the petitioner is that the title appeal No. 73 of 2010 preferred by the opposite party Nos. 1 and 2 herein is pending before the learned Civil Judge (Senior Division) 2nd Court at Howrah and the same was adjourned on several occasions on frivolous grounds. The record reveals that the learned Judge has fixed December 17, 2021 for argument.

In view of the order sought and proposed to be passed, there is no necessity of issuing any notice upon the opposite party. However, the petitioner shall be obliged to forward a copy of this application as well as this order upon the opposite parties or their learned advocates in the court below.

CO 1690 of 2021 is disposed of by requesting the learned Civil Judge (Senior Division) 2nd Court at Howrah to take up the hearing of the appeal on the next date fixed, i.e., on December 17, 2021 and to dispose of the same as expeditiously as possible and preferably by the end of March

2022 without granting any unnecessary adjournments to either of the parties.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
