State has prayed for modification of the order 02.09.2025 Court No. 35 D/L. No.86 Rakib dated 31.07.2025 wherein a direction was passed to the extent that "all the cases which involve the present petitioner be transferred to the same investigating officer being Special Cell (GS), Detective Department, Lalbazar". State has submitted a report today wherein it reflect that 15 cases have been registered wherein 10 of the cases are within the jurisdiction of the Kolkata Police and five cases are located within the domain of Bengal Police.

As such in respect of the aforesaid five cases the following order is being passed:

i) In respect of Islampur Cyber Police Station case no. 50/24 dated 11.11.2024, the case be transferred to CID;

ii) Darjeeling Sadar Police Station case no.

108/24 dated 18.11.2024 be also transferred to CID;

iii) Habibpur Police Station 315/24 dated 11.11.2024 has already been transferred to CID, West Bengal, as such the same be retained by the CID and the investigation taken to its logical conclusion.

iv) Burdwan Police Station case no. 1165/24 dated 15.11.2024 has been transferred to CID and charge-sheet has already been submitted in connection with the aforesaid case. Accordingly, it would be the State to decide whether supplementary charge-sheet is required to be submitted or the trial of the case progressed in accordance with law.

v) Chandannagar Cyber Crime Police Station case no. 30/24 dated 14.11.2024 was investigated by the Cyber Crime Police Station, Chandannagar Police Commissionerate, wherein the charge-sheet was submitted prior to the writ petition having been preferred on or about 17th of February, 2025.

Subsequently, supplementary charge-sheet was submitted

on or about May, 2025. It has been informed today that charge has been framed.

Since status of the aforesaid cases was not before this Court when the writ petition was disposed by an order dated 31.07.2025 the order is modified to the aforesaid extent.

So far as the investigation of the cases which are carried out by CID, in all those cases Special Superintendent of Police, CID, West Bengal would supervise the cases so that efforts are exhausted to take the investigation to its logical conclusion.

Learned advocate for the State submits that henceforth, if any further case surfaces if it is in the jurisdiction of Kolkata Police, the same would be transferred to Special Cell (GS), Detective Department, Lalbazar and if any case surfaces outside the territorial jurisdiction of the Kolkata Police the same would be investigated and/or supervised by the CID, West Bengal. With the aforesaid observations CAN 1 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.
