The matter appeared in the warning list on November 29, 2022 with a clear indication that the matter would be transferred to the daily cause list on December 5, 2022 before the regular bench. Since then the matter is appearing in the list. The present appeal is of the year 2007.

Today the appellant is not represented, nor any accommodation is prayed for.

It appears from the record that a co-ordinate bench on April 23, 2008 directed the matter to go out of the list with liberty to take appropriate steps for removing the defect no. 1 as pointed out by the stamp reporter. Office reported that defects pointed out by the stamp reporter was not removed.

Under such circumstances, the appeal stands dismissed for non-removal of defect.

In view of dismissal of the appeal, the connected application filed under 2764 of 2008 also stands dismissed. There will be no order as to costs.
