The grievance of the petitioner is that his wife obtained a decree from a competent Civil Court against Respondent Nos. 7 to 10, whereby her right, title, interest, and possession over the relevant premises were declared. It is submitted that, despite such decree, Respondent Nos. 7 to 10 have attempted to carry out unauthorized construction on the said premises. It is further submitted that Respondent Nos. 7 to 11 have not obtained any sanctioned plan from the concerned Panchayat. It appears that the petitioner made a representation to the concerned Panchayat by a letter dated December 30, 2024.

Despite being served, Respondent Nos. 7 to 11 are not represented.

In the aforesaid factual backdrop, I do not find any justification to keep this writ petition pending. Accordingly, the writ petition is disposed of with a direction to the Chaital Gram Panchayat, Amodpur, District North 24-Parganas, to take appropriate steps under Section 23(5) of the West Bengal Panchayat Act, 1973 in accordance with law within a period of three months from the date of communication of this order.

Accordingly, WPA 14323 of 2025 is disposed of.
