The petitioner is a member of Kulpi Panchayat Samity. Allegations have been made that the Pradhan of Chandipur Gram Panchayat has misappropriated the funds allotted under MGNREGA which was meant for construction of a village road in Gram Sansad No.7 of Chandipur Gram Panchayat. It has been further stated that some money has been withdrawn on the strength of job cards, which has been issued in the name of some labourers.

Be that as it may, without going into the disputes involved and without making any observations with the correctness of the contentions of the writ petitioner, this writ petition is disposed of with a direction upon the Block Development Officer

concerned to dispose of the complaint of the petitioner and other villagers dated June 28, 2021, in accordance with law. Before disposing of the said complaint, a thorough enquiry with the help of the officials of the office of the Block Development Officer and of those persons who were responsible for disbursement of the funds should be made. If necessary assistance of the police authorities shall also be taken.

A hearing shall be given to a representative of the village people, the Pradhan, any other elected members of the Gram Panchayat and the Panchayat Samity. A reasoned order shall be passed and communicated to all concerned. Thereafter action shall be taken as per law.

The entire exercise shall be completed within a period of three months from the date of communication of this order.

The writ petition is disposed of.

There will be, however, no order as to costs. Parties are directed to act on the basis of the server copy of this order.
