Mr. Shamit Sanyal Ms. Priyakshi Banerjee ...for the petitioner Mr. Rezaul Hossain ...for the State The grievance of the petitioner is directed against the selection process of Accredited Social Health Activist (ASHA) pursuant to a recruitment notification dated 8th September, 2022 for Block - Krishnanagar - II, Gram Panchayat - Belpukur, subcentre - Sonadanga, Service Area - Sonadanga Majher Para.

It is submitted on behalf of the petitioner that the selection of the respondent no. 10 is illegal and contrary to the mandatory requirement that the selected candidate must be a resident of a particular locality. In support of such contention, the petitioner relies on a voter list, which prima facie shows that the respondent no. 10 is not a resident of the above constituency.

It is submitted on behalf of the State that, in an earlier round of litigation being WPA 8258 of

2023, a Coordinate Bench had found the engagement of the said Salma Khatun being the respondent no. 10 to be erroneous and illegal. In view of the fact that the primary grievance of the petitioner has been redressed in WPA 9258 of 2023, there is no merit in the present writ petition.

The writ petition has become infructuous and the same stands dismissed.

In view of the above, nothing survives in the present writ petition.

WPA 14489 of 2023 stands dismissed.
