Mr. Kushal Biswas ... for the State - Respondent(s) The petitioner approached this court as inspite of information being furnished, the Officer-in-charge of Baduria Police Station did not take proper steps against the respondent no.6, namely, Swapan Das.
The records of the writ petition reflect that such information was furnished on or about 07.05.2024. The allegations primarily relate to an incident of 05.05.2024 wherein the petitioner was wrongfully confined in a shop-room and subsequently some illegal money was demanded from him.
Having considered that the
petitioner and the private respondents are known to each other and the police authorities are in receipt of the information, I am of the view that in case no steps have been taken by the police authorities till date, the petitioner would approach the jurisdictional Magistrate under the relevant provisions of law. The learned Magistrate would, in such circumstances, assess and ascertain regarding the genuinity of the accusations, thereafter, pass necessary directions as he/she deems fit and proper.
As none appears on behalf of the State, Mr.
Kushal Biswas, learned advocate, who ordinarily appears on behalf of the State, is directed to appear on behalf of the State. His appointment may be regularised by the concerned authority.
With the aforesaid observations, WPA 15476 of 2024 is disposed of.
