Mr. Amitabrata Roy Mr. Pradip Kumar Saha ...for the petitioners Mr. Supriyo Chattapadhyay Ms. Iti Dutta ..... for the State Mr. Ratul Biswas .... for the Board Although learned counsel for the Board submits that the prayer of the petitioners is infractuous since the concerned monitoring selection ended in March, 2019, there are at least two documents in the writ petition which shows that the Chairman, District Primary School Council, Howrah wrote to the Secretary, West Bengal Board of Primary Education on 22nd February, 2019 asking the latter to consider the case of the writ petitioners before this Court.

Hence, even if the selection program ended in March, 2019, as submitted on behalf of the Broad, there is no reason why the writ petitioners' case was not considered by the Secretary, West Bengal Board of Primary Education till date.

The prayer made on behalf of the writ petitioners is for a direction on the Secretary, W.B.B.P.E. to act in

terms of the communication dated 22nd February, 2019 in view of the delay on behalf of the concerned respondents in the matter.

Upon considering the relevant materials, this Court is of the view that the Secretary, W.B.B.P.E., being the respondent No. 6, should be directed to send an action taken report to the School Education Department on the basis of the communication dated 22nd February, 2019 within three weeks from date. A copy of such report shall be sent by the School Education Department to the petitioners within a week from the date on which such report is received by the Department. The petitioners shall be at liberty thereafter to take appropriate steps.

WPA 15300 of 2021 is disposed of in terms of the above direction.

Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
