The writ petitioner has prayed for grant of fresh permit, before the concerned authorities vide his letter dated April12, 2024. The requisite 'Form-I' is also duly submitted.

Mr. Sanat Kumar Ray, learned counsel appearing for the writ petitioner indicates to the other fact also as involved in this case, that is, vide letter dated April 22, 2024 the writ petitioner has surrendered the permit earlier granted to him, that is, Permit No. 202/T/BR attached to vehicle No. WB -15C/6536l as per Rule 158 of W.B.M.V. Rules, 1989.

On behalf of the writ petitioner, it is now stated that the petitioner's prayer for grant of new permit of stage carriage on the route Haripal to Dhaniakhali via Basudebpur, Olipur Bhanderhati be directed to be immediately considered by the concerned respondent authority/respondent no. 3.

Mr. Pantu Deb Roy, learned Additional Government Pleader is representing the State.

So far as the facts as enumerated by the petitioner in this case and mentioned above, he has not raised any objection.

Heard Learned Counsels had perused the record. 8.

This writ petition is disposed of with the following directions.

(i). The written representation submitted before the concerned authority, by the writ petitioner, dated April 12, 2024 along with the statutory form be considered and disposed of by the authority/ respondent no. 3, with a reasoned order, within a period of six weeks from the date of communication of copy of this order.

(ii). In doing so, respondent No. 3 shall afford an opportunity of hearing to the petitioner and any other person\s as it may think fit and proper.

(iii). The decision of the Board may be informed to the writ petitioner within one week from the date of such order.

Since no affidavits are called for, allegations made in the writ petition, are deemed to have been denied by the respondents.

10. This writ petition being WPA No. 15444 of 2024 is disposed of, along with the pending applications, if any.
