The writ petition is disposed of with a direction upon the Regional Passport Officer, Kolkata to dispose of the proceeding initiated vide notice dated November 29, 2023, proposing to impound the passport of the petitioner on the ground of suppression of a material information about the pendency of a criminal proceeding, in the application for passport.

It appears that the passport was issued on the basis of the application and upon receipt of the information that a criminal case was pending against the petitioner, the show cause notice was issued. The petitioner has already furnished a reply. Under such circumstances, the matter has to be decided by the authorities.

Hence, the writ petition is disposed of as directed hereinabove.

The decision shall be taken upon hearing the petitioner. The petitioner shall be entitled to place the relevant decisions of the Hon'ble Apex Court and this Court, before the authority concerned.

The authority shall pass a reasoned order within a period of two months from the date of communication of this order.

There shall be no order as to costs.

Parties are directed to act on the basis of the server copy of this order.
