1. Heard learned Counsel for both the parties.

2. The petitioner is stated to be a proclaimed offender and trial in the case having commenced, eight witnesses are stated to have been examined in the meantime.

3. Regard being had to such facts and gravity of offence, we are not inclined to exercise our discretion in favour of the petitioner under Section 438 Cr.P.C.

5. Accordingly, the prayer for the anticipatory bail is rejected.
