The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause of any prejudice to the opposite parties, as such, service of notice of the present revisional application upon the said opposite parties is dispensed with. The petitioners are the plaintiffs of Ejectment Suit No. 9 of 2017 pending before the learned Civil Judge (Junior Division), Additional Court, Sealdah, District: 24 Parganas (South).
The petitioners are complaining inordinate delay in disposal of the said suit and praying a direction upon the learned Trial Judge for expeditious disposal of it. It appears from the certified copy of the orders passed in the said suit that the witness action from the plaintiffs end has commenced and the Court is fixing for evidence-in-chief of PW-3.
Mr. Debabrata Karan, learned counsel appearing on behalf of the petitioners, submits that the P.W.-3 would be the last witness of the plaintiffs and he will tender his examination-in-chief and documents, if any, on the next date fixed.
He informs this Court that the said next date is November 10, 2021.
The learned Trial Judge is requested to allow the P.W.-3 to conclude his evidence-in-chief on the said date and offer himself for the cross-examination on the said date itself. The suit being a suit for ejectment and is pending since 2012.
The learned Trial Judge is requested to dispose of the said suit as expeditiously as possible preferably within a period of four effective working months of the Court below from the date of communication of this order and in doing so shall not grant any unnecessary adjournment to either of the parties.
CO 1700 of 2021 is disposed of with the above terms without any order as to costs.
Urgent photostat certified copy of this order, if applied for, be supplied to the party subject to compliance of all requisite formalities.
