From the same, it appears that the wife of the petitioner has requested not to proceed with the present case. It is submitted that the petitioner himself is critically and terminally and is not in a position to express his unwillingness to proceed with the matter by him. Mr. Narayan Prasad Agarwala, along with Mr. Pratick Bose, learned Advocates, appear for the State, rests the matter to the discretion of the Court.

Considering the document as above, I do not find any cogent reason to proceed with the matter. Hence, the same is dismissed for non-prosecution.

Let the copy of the e-mail dated 14th September, 2022 be kept with the record.
