Mr. Ghosh, learned advocate appearing on behalf of the Department of Municipal Affairs submits on instructions that the Government has taken a conscious decision to include Chakdaha Municipality under the Amrut-2 scheme. The learned advocate fairly submits that there was water crisis in the areas under the Chakdaha Municipality. On account of allegations of water shortage, the grievances of the persons of that locality had been addressed by the government. By the initiative of the department and Chakdaha Municipality, the court is assured that the grievances of the petitioners and other persons in the locality will be addressed soon.

The Board of Administrators of the Chakdaha Municipality has also filed a report from which it appears that the Board had decided to take immediate steps to

ensure supply of water to approximately 400 pending applicants. Let such report be kept on record. This Court was initially of the opinion that an undertaking to the above effect must be submitted by the State respondents as also the Municipality. Right to grant of water connection of the persons living under the Chakdaha Municipality must be addressed with the promptitude it deserves. However, on the assurance of the learned advocates, who appear before this Court on behalf of the respective parties, the Court does not call for a further undertaking.

The writ petition is disposed of with a direction upon the respondents to ensure that the petitioners and the other applicants, if otherwise eligible, be granted the said water connection within April 30, 2022.

The Court appreciates the initiative taken by the Municipality and the Department of Municipal Affairs, Government of West Bengal and records that this order shall be treated as peremptory. It is not expected that the respondents will fail their citizens and deprive them of the basic element required for their survival.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
