Petitioner is aggrieved by the fact that the respondents being miscreants who have no involvement in respect of the property is obstructing the construction work of the petitioner.

Learned advocate for the Municipality submits that sanction plan has been granted to the petitioner. State has submitted a report. Report reflects that T.S. case no. 39/09 is pending which is controverted and the certified copy of the order has been referred to by the learned advocate appearing for the petitioner, wherefrom it reflects that the Title Suit no. 39/09 has been dismissed.

In view of the grievance of the petitioner and the Municipality accepting the position of the issuing of

sanction plan in favour of the petitioner, police authorities would ensure that there is no breach of the peace and/or tranquility at the locale and the legal right of the petitioner is not infringed in any manner or the other.

With the aforesaid observations WPA 14255 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to both the parties.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
