Bindeswar Das & ORS v. State Of West Bengal & ANR
C.R.R. No.2093 of 2012 (Via Video Conference) D/L58.
September 9, 2021 Bpg.
In Re: An application under Section 401 of the Code of Criminal Procedure read with Section 482 of the Code of Criminal Procedure. Bindeswar Das & Ors.
Versus
The State of West Bengal & Anr.
The present revisional application was preferred in respect of a proceeding under Section 107 of the Code of Criminal Procedure arising out of M.P. Case No.417 of 2011 pending before the learned Executive Magistrate, Sealdah.
Having regard to the nature of the proceedings and substance thereof, I am of the view that no interference is called for at this belated stage. Further, the records of the revisional application reflect that the revisional application is yet to be admitted. Consequently, the question of facts so raised by the petitioners do not seem to be convincing and, as such no interference is called for.
Accordingly, CRR 2093 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
