Nayeemul Haque ..for DPSC, Murshidabad As the Director of Pension, Provident Fund and Group Insurance is not a party in the writ application, I grant liberty to the petitioner to add him as a party respondent in course of the day.
It has been submitted by the petitioner that the District Primary School Council, Murshidabad has rectified the mistake and it has been decided that the mother of the deceased teacher and widow of the deceased teacher both will get Rs. 46,592.00/- each. It has also been recorded in the order dated 08.02.2023 that the Murshidabad District Primary School Council is not the authority for sanctioning pension.
Therefore, I direct the District Inspector of Schools (P.E.), Murshidabad, who is the appropriate authority for sanctioning family pension to grant an opportunity of hearing to the petitioner and her daughter in law and to decide the question of payment of family pension.
It has been submitted by the petitioner that the daughter in law is already remarried.
In respect of the gratuity amount, the Director of Pension, Provident Fund and Group Insurance shall decide the amount to be paid to the petitioner and her daughter in law and in this regard the Director of Pension, Provident Fund and Group Insurance shall give an opportunity of hearing to the petitioner and also the daughter in law within a period of four weeks from the date of communication of this order and to pass a reasoned order and to take steps accordingly. With the above observation and direction, this writ application is disposed of.
