The petitioner says that he is in custody for 243 days. Charge is yet to be framed. A co-accused person, Nazimul Sk, has been enlarged on bail by this Court. He should also be granted bail.

Learned advocate for the State draws our attention to the material in the case diary which, prima facie, incriminate this petitioner. We further see that this petitioner does not stand on the same footing as Nazimul Sk who was granted bail by a Co-ordinate Bench by the order dated February 6, 2024. By the same order, the petitioner's prayer for bail was rejected by the Co-ordinate Bench.

There is no change of circumstances since the rejection of the petitioner's prayer on February 6, 2024. We are not inclined to grant bail to the petitioner. CRM (DB) 1809 of 2024 is dismissed.

However, we are told that July 17, 2024 has been fixed as the date for consideration of the charges. Let the charges be considered positively on that date. Thereafter, learned Trial Court should expedite the trial to the fullest possible extent so that the same can be concluded at an early date. Let this order be communicated by the parties to the learned Trial Court.
