W.P.A. 13689 of 2018 (Sukumar De vs. State of West Bengal & Ors.) None is present for the petitioner though the petition is pending since 2018.

Having perused the record, it is noticed that the petitioner is claiming that the cremation ground of Hindu is situated in Dag No. 380 under Mouza Baklasha Ramnarayan, J. L. No. 162, Khatian No. 15/1 measuring about 2.55 acres at P.S. Debra, District Paschim Medinipur.

The allegation of the petitioner is that the private respondents have been damaging the said ground and the representation filed by the petitioner in this regard has not been considered. The further allegation of the petitioner is that the private respondents should not be permitted to use the land in question.

More than 3 years have passed after filing of the petition and today no one has come forward to prosecute it. Hence, we find no justification to keep the petition pending.

W.P.A. 13689 of 2018 The record reflects that a mass representation in this regard was filed which was forwarded by the Block Development Officer, Debra Block Development vide communication 29th December, 2017 to the Block Land and Land Revenue Officer, Baliachak, Paschim Medinipur. The action in pursuance thereto is not on record.

Hence, the respondent No. 5 is directed to look into the grievance of the petitioner as reflected in the mass representation and take an appropriate decision in accordance with law expeditiously, if the issue is still pending.

Department is directed to send a copy of this order to the respondent No. 5.

The petition is accordingly disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
