Petitioner was accompanying the co-accused from whom narcotics was recovered. The attending circumstances prima facie disclose common intention in the possession of narcotics. Under such circumstances and in view of the statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

The application for bail is thus rejected.

Chemical examiner's report be filed before the trial court within two months from date.
