Smt. Sayani Banerjee (Das) Ms. Nipa Sarkar .....For the Petitioner The revisional application was preferred in connection with Misc. Case No.52 of 2008 in respect of the judgment dated 05.05.2009 passed by Learned Additional Chief Judicial Magistrate, Katwa, Burdwan wherein the learned Court on an appreciation of the materials available in evidence arrived at a conclusion awarding maintenance of Rs.10,000/- per month.

Having regard to the reasons so assigned by the Learned Trial Court, I am of the opinion that the foundation of such order was on the factual basis of the evidence adduced by both the parties and on scrutiny of the materials appearing in evidence. So far as the award of maintenance is concerned, the Learned Trial Court took into account the capacity of the present petitioner and the expenses required for an individual to survive.

Having regard to the reasons so assigned by the Learned Additional Chief Judicial Magistrate, Katwa, Burdwan in her judgment and order dated 05.05.2009, I am of the opinion that no interference is called for.

Accordingly, CRR 2310 of 2009 is dismissed.

All pending connected applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
