Mitra .... for the State Mr. Debjit Mukherjee .... for the WBSEDCL Learned counsel for the petitioner contends that despite an order of this court and the District Magistrate, Hooghly, pursuant to the order of this court, the Distribution Company has not reflected in its estimate the adjustment of the quotation amount which has already been deposited by the petitioner to the Distribution Company. When the petitioner sought for detailed break-up, the West Bengal State Electricity Distribution Company Limited (WBSEDCL) merely reiterated its previous estimate, which does not disclose any break-up whatsoever.

Although learned counsel for the WBSEDCL is somewhat justified in submitting that the exact break-up of each and every component of the estimate

cannot be given, since it would entail extreme complications, if the same is to be given for all consumers, the petitioner is justified to the extent that the WBSEDCL is required to reflect in its estimate as to what was the quotation amount paid by the petitioner and the amount now estimated by the petitioner and give an adjustment to the quotation amount already paid, in the final amount payable. Accordingly, WPA No. 14528 of 2023 is disposed of by directing the WBSEDCL to issue a fresh estimate to the petitioner within a week from date, indicating the exact amount estimated at the present juncture by the petitioner and also reflecting the adjustment given of the said amount with the quotation amount previously deposited by the petitioner.

However, it is made clear that it will be open to the petitioner, if aggrieved with the quantum so raised by way of estimate by the WBSEDCL, to approach the concerned Grievance Redressal Officer (GRO) for resolution of the said dispute. Nothing in this order shall preclude the petitioner from so moving. There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
