Petitioner is aggrieved by the fact that in spite of Parnashree P.S. Case no. 141/2023 having been registered for investigation and the same concluding in a charge-sheet, however as the accused persons are not participating in the proceedings consequent to which there has been no progress in the case.

Learned advocate appearing for the State submits that one of the accused persons have expired, although warrant of arrest has been issued, but the private respondent cannot be traced.

Having regard to the fact that police authorities have taken steps but no conclusive report has been submitted before the jurisdictional Court, I direct the police authorities to immediately submit a report relating to the fate of the warrant of arrest. The jurisdictional Court on receipt of such report will proceed to the

harsher process of law, if required split up the trial and proceed with the trial of the case.

With the aforesaid observations WPA 14437 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
