Case No.786 of 2021 dated 31.08.2021 under Sections 408/420/120B of the Indian Penal Code (G.R. Case No.3545 of 2021).

1. Heard the learned Counsel for the parties.

2. The co-accused persons namely Suvankar Roy and his wife are stated to be released on anticipatory bail in the meantime. Charge-sheet has been filed. From the police papers it is found that in two transactions i.e. one by RTGS and one by NEFT Rs.40 lacs have been deposited in the account of the petitioner, who is admittedly an employee of the de-facto complainant and was in-charge of the accounts department. All the documentary evidences have already been collected in the meantime as stated by the learned counsel for the State.

3. Regard being had to such facts and submissions, factum of permanent residence of the petitioner, nature of

evidence and completion of investigation, it is directed that the petitioner shall surrender before the learned ACJM, Bongaon, North 24-Pgs in the G.R. Case No.3545 of 2021 arising out of the aforesaid P.S. case within 15 days from today. On his surrender and application for bail, he shall be released on bail by the aforesaid Court on such terms and conditions as deemed just and proper in the facts and circumstances of the case.

4. Accordingly, the prayer for the anticipatory bail is allowed.

5. The application being CRM(A) 2517 of 2023 is disposed of.

6. The learned court below is hereby directed to act upon the server copy of this order.
