By consent of the parties the revisional application is taken up for consideration along with the application being CRAN No. 3 of 2025.
Heard learned counsels for the parties.
The petitioner who is the husband of the opposite party is aggrieved by the order passed by the learned Judicial Magistrate, 3rd Court, Contai in Misc. Case No. 290 of 2021 on April 25, 2023 disposing of the prayer for interim maintenance ex parte and directing the petitioner to pay Rs. 4000/- per month to the opposite party as interim maintenance from the date of filing of the case.
By an order passed on October 18, 2024, this Court granted stay of operation of the said order and directed the petitioner to pay Rs.2000/- per month as maintenance to the opposite party.
The warrant of arrest issued against the petitioner in Misc. Execution Case No. 108 of 2023 was also stayed for a limited period which was extended from time to time.
Learned counsel for the petitioner submits that the petitioner has been complying with the said direction of this Court.
Learned counsel for the opposite party submits that the learned trial Court be directed to dispose of the application under Section 125 of the Code of Criminal Procedure within a specified time frame.
In view of the submission made on behalf of the parties, the learned trial Court is directed to take the proceedings to its logical conclusion within three months from the next date of hearing fixed before him upon granting reasonable opportunity of hearing to both the parties and without granting any unnecessary adjournment to either of the parties, in accordance with law. Pending disposal of the application, the petitioner shall continue to pay Rs.2000/- per month to the opposite party, the amount for each month being payable within seventh day of each succeeding month. The arrear maintenance due shall be liquidated by the petitioner and the mode and manner of payment of the same shall be decided by the learned trial Court.
No coercive steps be taken against the petitioner in connection with the application under Section 125 of the Code of Criminal Procedure till the disposal of the application subject to the petitioner complying with the order of this Court.
With the above observations and directions the instant revisional application being CRR No. 2351 of 2024 is disposed of. Consequently the connected applications being CRAN No. 2 of 2024 and CRAN No. 3 of 2025 are disposed of. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
