The writ petition is finally heard in presence of the learned advocates representing the petitioner, School Service Commission, Board and the State-respondents. As per the report of the Chairman, West Bengal Central School Service Commission dated 10th July, 2024 the Commission has indicated three schools in tabular form also disclosing the number of teachers and number of students present in those three schools. Copy of the said report dated 10th July, 2024 was also handed over to the learned advocate for the petitioner who on instruction today submits that petitioner is willing to be transferred to a post which is lying vacant in Khanpur Nirmala Bala Sarkar Girls High School, Kolkata.

Mr. Sourav Mitra, learned advocate representing the Commission submits that meanwhile it has been found by the concerned authority of the Commission that there will be no difficulty in re-recommending the petitioner for transfer to Khanpur Nirmala Bala Sarkar Girls High School, Kolkata as the posts where petitioner is to be transfer is lying vacant.

Concerned District Inspector of Schools is also represented by Mr. Arindam Chattopadhyay, learned advocate who submits that petitioner can be rerecommended to the aforesaid school. In view of the report furnished on behalf of the Commission the concerned authority of the Commission is directed to re-recommend the petitioner by 7 (seven) days from date and Board to issue transfer order in favour of the petitioner by 7 (seven) days thereafter on receiving copy of the re-recommendation memo from the Commission and the school authority in its turn shall issue appointment letter within 7 (seven) days thereafter in order to facilitate the petitioner to join the transferred post.

With the aforesaid directions the writ petition stands disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
