Mr. Manoranjan Mahata ...... for the State Petitioner renews his prayer for bail. It is submitted that he is in custody over one year and eight months. He submits coaccuseds are on bail. Learned Additional Public Prosecutor for the State opposes the prayer for bail.
We have considered the materials on record. Statements of eye witnesses show petitioner is the principal accused who assaulted the victim resulting in his death. He does not stand on the same footing with co-accuseds who have been enlarged on bail by this court.
In view of the aforesaid incriminating materials and as his prayer for bail was rejected earlier, we are not inclined to grant bail to the petitioner at this stage.
