27.07.2023 Item No.20 gd/ssd MAT/1118/2023 IA NO: CAN/1/2023 UNITED ORDER AND SUPPLY COOPERATIVE SOCIETY LIMITED VS STATE OF WEST BENGAL AND ORS.

Mr. Satrajit Sinha Roy, Ms. Amrita Maji ... for the Appellant.

Mr. Amal Kr. Sen, Ms. Ashima Das (Sil) ... for the State.

1. The appellant is the writ petitioner and challenged the order dated 12.06.2023 in WPA 1641 of 2023.

2. The prayer in the writ petition was to set aside a notification issued by the Government of West Bengal as earlier i.e. on 16.06.2010. The writ petition was filed in the year 2023 and it is an admitted fact that the appellant-society was registered much after the notification was issued by the Government of West Bengal dated 16.06.2010.

3. Therefore, the learned Single Bench was fully justified in dismissing the writ petition.

4. The contention of the learned advocate for the appellant is that the diet supply for the hospitals based on such notification has been restricted to one

set of organizations, namely, Self Help Groups and this, according to the appellant, is unreasonable.

5. Admittedly, it is a policy decision taken by the Government probably with a view to uplift the Self Help Groups. We find that no error in the approach of the learned Single Bench while declining to grant the relief sought for.

6. For the above reasons, no grounds have been made out by the appellant to interfere with the order passed in the writ petition.

7. Accordingly, the appeal fails and the same is dismissed.
