Today when the matter has been called none appeared on behalf of the petitioner, earlier, the revisional application was called on 23rd June, 2023 when the learned advocate appearing on behalf of the petitioner prayed for an accommodation. However, the State is represented.

The subject matter of the revisional application is a peculiar set of circumstances where the accused himself has made an application for polygraph test. The learned trial court after considering such an application on 22nd March, 2023 disposed of the application holding that if the Investigating Agency so feels at a later stage of the investigation it would exercise such discretion. The reasons so assigned by the learned trial court after considering the materials available in the case diary particularly the incriminating one appearing against the accused is the basis of the finding. I find no illegality in the aforesaid order and as such there

is no scope for interference.

Accordingly, the revisional application being CRR 2245 of 2023 is disposed of.

Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court.
