Learned counsel for the petitioner submits that the petitioner had purchased a property and registered the same. The de facto complainant is trying to harass the petitioner by making absurd claims.
Learned counsel for the State denies the allegations, opposes the prayer for anticipatory bail and submits that the de facto complainant's husband had owned the property in question. Taking advantage of the aliases of the owner, the petitioner engaged someone as a seller and prepared a forged
deed for transfer of the property in question. In fact, the de facto complainant's husband had died long ago and this was within the knowledge of the petitioner as the petitioner happened to be the nephew of the said deceased. Learned counsel for the de facto complainant strongly opposes the prayer for anticipatory bail.
Considering the nature of allegations and the incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
