For the Private Respondents Re: WPA 11473 of 2025 In the writ petition being WPA 11473 of 2025, this Court by an order dated 21st May, 2025 directed the Deputy Superintendent of Police to ensure that on 31st May, 2025 adequate police personnel would be deployed so that there was no interference with the Puja as well as the festivals organised and conducted by the Trustee namely Sree Sree Raksha Kali Mata Thakurani Sebayat Trust. The writ petition was disposed of with certain directions. The 6th respondent filed an application being CAN 1 of 2025 seeking modification of the said order. The matter was dealt with by the same learned Judge. By an order passed on 30th May, 2025 this Court recorded the submission and undertaking given by the

Trustee that they were not going to conduct the Puja on the relevant date. The police authority was directed to monitor the situation from 30th May, 2025 to 9th June, 2025 and, if required, police picket and police contingent were directed to be deployed to dissuade any situation which would blow out of proportion arising out of the issue relating to the Puja referred to in the application as well as the writ petition. In view of the fact that the writ petition and the application were in respect of the Puja which were scheduled to be held on 31st May, 2025, the application has become redundant and is accordingly disposed of.

Consequently CAN 2 of 2026 stands disposed of. WPA 11473 of 2025 be tagged from WPA 14291 of 2025.

Re: WPA 14291 of 2025 (CAN 2 of 2026) Report submitted by the State is taken on record. Heard learned counsels for the parties.

The petitioner who has been declared to be the Shebait/Manager of the deity Sree Sree Raksha Kali Mata Thakurani is further declared to be entitled to manage the affairs of the deity and the property in question and to conduct Seba Puja/Nitya Puja and Annual Puja as well as the administration in accordance with the custom and discipline by a judgment delivered on 24th December, 2025 in a title appeal being no.14 of 2024.

The petitioner seeks to organise a special Puja on 28th January, 2026 and seeks police assistance for the purpose since he apprehends disturbance/obstruction from the private respondents.

It appears from the report submitted by the State that on earlier occasions when such puja was organized by the petitioner, the police authority has rendered sufficient and adequate assistance and has deployed good number of police personnel to monitor the situation.

The private respondents deny and dispute the allegations made by the petitioner.

Upon consideration of the material on record, it appears that the judgment delivered in the title appeal in favour of the petitioner has not been assailed till date. By the said judgment the petitioner has been permitted to conduct puja and manage the affairs of the deity in the property in question.

The rights claimed by the private respondents have been denied by the learned appellate Court. They have been restrained from interfering with or obstructing the functions of the plaintiff as shebait or forcibly taking over, collecting, handling or dealing with the offerings/donations as persons in control/management.

Since the petitioner proposes to organize a special puja tomorrow, that is, on 28th January, 2026, he is at liberty to do so in view of the declaration of his right by the learned appellate Court.

Since the petitioner apprehends resistance from the private respondents, the police authority is directed to render necessary assistance to the petitioner so that the puja is performed smoothly, peacefully and without any disturbance from any corner whatsoever.

The police authority shall deploy sufficient police personnel in and around the area in order to avoid any untoward incident and to ensure maintenance of peace and tranquility.

However, the public at large including the private respondents shall be at liberty to offer puja as devotees and in no other capacity whatsoever, without interfering with/obstructing the management and control of the deity/puja by the petitioner.

The writ petition along with the connected application being CAN 2 of 2006 are disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
