Mr. Sourat Nandy ... for the Petitioner(s) Mr. Siddhartha Ghosh ... for the State-respondent(s) Re The petitioner is aggrieved by the fact that the police authorities are not responding to the overt acts which are being inflicted by the private respondents, and, presently, the situation is deteriorating to such an extent that she was forced to leave her residence pursuant to Thakurpukur P.S. Case No. 357 dated 24.12.2024 having been registered at her instance.

The prayer of the petitioner is that she may be allowed to enter at her own residence.

On the other hand, learned advocate for the State has submitted a

report which reflects that a criminal case has already been initiated in which charge-sheet has already been submitted and warrant of arrest has been issued.

According to the learned advocate, in order to face inconveniences, the petitioner purposely is not staying at her residence.

Be that as it may, since the petitioner is not an accused in the criminal case, if the petitioner approaches the learned Court in seisin of Thakurpukur PS Case No. 357 dated 24.12.2024 with necessary prayers, the learned Magistrate would consider the same and pass necessary directions so that the petitioner can enter her residence without being hindered and obstructed by any other miscreants. Obviously, the same will not preclude the police authorities if they intend to carry out any act in discharge of their official duties.

With the aforesaid observations,

WPA 14383 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the petitioner.
