Learned advocate appearing for the petitioner is aggrieved by the fact that pursuant to the decree passed by the Civil Court and the direction passed by this Court in WPA 3387/2025, the petitioner initiated cultivation when he was resisted in such a manner that he had to suffer the loss of certain materials.

Police authorities have in connection with Hingalgang Police Station case no. 227/2024 dated 03.12.2024 registered a case under Section 303(2) of the BNS. A Power Tiller has been recovered, however, other subject matter of the case being the mobile phone and van rickshaw is yet to be recovered. Police authorities are carrying on the investigation.

So far as the power tiller is concerned, petitioner would approach the jurisdictional Magistrate in seisin of the issue. In case, such an application is filed the

jurisdictional Court would within a period of 15 days dispose of the same after obtaining a police report. Police authorities would continue their vigil and ensure no further breach of the peace takes place. With the aforesaid observations WPA 14484 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
