Learned Additional Public Prosecutor for the State opposes the prayer for bail.

We have considered the materials on record. Statements of eye witness recorded under Section 164 Cr.P.C shows active participation in assault of the victim.

In view of the aforesaid incriminating materials and gravity of the offence, we are not inclined to grant bail to the petitioner at this stage.
