Affidavit of service filed on behalf of the petitioner is taken on record.

Despite service, no one appears on behalf of the private respondents although the State is represented. Learned counsel appearing on behalf of the petitioner submits that the private respondents had made unauthorised construction on public land. For this, the petitioner made a representation before the concerned authority/respondent no.7 to demolish the unauthorised structure in terms of the West Bengal Public Land (Eviction of Unauthorised Occupants) Act, 1962. But, no response has been forthcoming.

Learned senior counsel representing the State submits that first, it has to be found out whether the construction has been made on public land. In view of the same, the representation made before the concerned authority may be considered in accordance with law.

In view of the above, let the representation made by the petitioner be considered by the respondent no.7 in accordance with law and as expeditiously as possible, preferably within a

period of eight weeks from the date of communication of this order.

With these observations, the writ petition is disposed of. It is made clear that the merits of the case have not been gone into.
