Mr. Haradhan Mondal ...for the petitioner Ms. Sucharita Roy ....for the State Petitioner is aggrieved by the fact that his land is being encroached by the private respondents. To that effect, several representations have been made to the administration including the Inspector-in-Charge of the local police station. Petitioner submits that there was a field enquiry conducted.

Learned Advocate for the State has submitted a report. Report reflects that there has been dispute over certain stalls being erected which are not in the land of the petitioner. However, learned advocate for the petitioner claims that such stalls have been constructed in his land. There is a factual dispute. Accordingly, I direct the petitioner to submit a fresh representation (as earlier representations were in the years 2018-2020) within a period of four weeks. The Officer-in-Charge of Kirnahar Police Station will

dispose of such fresh representation and inform his finding to the petitioner within a period of four weeks. Report submitted in Court be kept with the record. A copy of the report be handed over to the learned Advocate appearing for the petitioner. With the aforesaid observations WPA 14551 of 2023 is disposed of.

There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
