The present revisional application relates to expeditious disposal of Narayanpur Police Station Case No.35 of 2018 dated 11.12.2018 under Sections 498A/306 of the Indian Penal Code which is pending before the learned Additional District and Sessions Judge, Fast Track, Second Court, Barrackpore. In view of the anxiety expressed by the petitioner who has been implicated in connection with the instant case, I direct the copy of the revisional application be served upon Ms. Manisha Sharma, learned advocate, who ordinarily appears on behalf of the State. Her appointment may be regularised by the concerned authorities.
Learned advocate submits that the case was initiated in the year 2018. The Investigating Agency submitted charge-sheet within a reasonable period of time and charge has already been
framed. Learned advocate further submits that in the charge-sheet the police authorities have cited five witnesses in support of its case. The grievance of the petitioner is that in spite of seven schedule being fixed by the learned trial court, only one witness till date has been examined.
In view of the anxiety expressed by the petitioner, I find the same to be justified.
Accordingly, I direct that the learned court would fix at least a schedule consisting of three dates in every two months for taking the trial to its logical conclusion within a reasonable period of time. If no witness is present on the date so concerned, the court should first ensure whether the process which has been issued has reached the witness concerned. In case there is any grey area in respect of the service to the witness concerned, the learned court would seek the assistance of the DSP/SDPO/Additional SP-InCharge of Narayanpur Police Station for effecting service upon the witness concerned. The public prosecutor conducting the case should ensure regarding the production of the materials, exhibits and documents which are necessary on the date on which the witnesses are examined. All stakeholders should co-operate with the learned trial court so that the trial is concluded at the earliest. With the aforesaid observations, CRR 2249 of 2023 is disposed of.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
