Heard the learned Advocates appearing for the petitioner and the State.

Petitioner is in custody for about three years and five months. It is submitted that he has been falsely implicated in the instant case.

Learned Advocate appearing for the State opposes the prayer for bail and submits petitioner who is the brother-inlaw of the deceased along with her husband brutally assaulted her resulting in her death.

We have considered the materials on record particularly the minor children of the deceased prima facie implicating the petitioner in the alleged crime.

In view of the gravity of the offence and the prima facie involvement of the petitioner in the alleged crime and as the

trial is in progress, we are not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected.
