In support of his contention, he relied on the following two decisions (i) Amal Kumar Giri & Ors.-vs.-Nani Gopal Paira & Ors., reported in 2004 (2) CLJ (Cal) 161 and (ii) Naymul Haque @ Nainul Haque-vs.-Allauddin Sk. passed in Co 1164 of 2015 passed by a Division Bench of this Court.
